Does a hot tub need a fence in Montgomery County?

There's no countywide pool code in Montgomery County. Whether your spa needs a barrier depends on which township's rules you live under, and how they define a pool.

Short answer

It depends on the municipality, because Montgomery County has no single pool code. Abington exempts a spa from its barrier rule if it has a safety cover meeting ASTM F1346. Whitpain (Blue Bell) adopted the 2018 pool and spa code, which sets a 48-in barrier for pools and spas. Towamencin and Upper Moreland apply their pool-fence rules to water more than 2 ft deep. Check with your township before the pad is poured.

Why the answer changes at the township line

Pennsylvania townships and boroughs write or adopt their own pool rules. Some use depth ("more than 2 ft of water"), some name spas outright, and some exempt a covered spa. A hot tub that needs no fence in Abington may need one a few miles away, so start with the municipality that issues your permit, not the post office name on your address.

Checked October 2026 from the cited code and township pool documents. Whether a hot tub counts as a "pool" under a depth-based rule is the township's call; we confirm before we quote.

One wrinkle in Abington: the building code's pool-enclosure section (§ 421.9) says pool covers don't count as the enclosure, while the newer requirements sheet exempts covered spas. If you're relying on the cover, get the building department's answer in writing. In Whitpain, ask whether the adopted code's spa provisions allow a cover in place of a barrier.

Cover or fence: what to weigh

  • A cover works only when it's on and latched. A fence with a self-closing gate works on its own.
  • A fence adds privacy if you build it as a screen, and a hot tub is the one spot most people want screened.
  • A fence can serve two jobs if the spa sits next to a pool; one barrier can enclose both, sized to the stricter rule.

Privacy screens around a hot tub

Most townships here cap back-yard fences at 6 ft, and Upper Gwynedd and North Wales allow 6 ft 6 in. Abington limits solid pool enclosures to 6 ft. A short run of 6-ft vinyl or composite on the two sides facing the neighbors, closed with aluminum and a self-latching gate on the open sides, gives privacy and a code-ready barrier. Composite privacy runs about $110–160 per foot installed, vinyl about $45–75, and aluminum about $50–85 for 4–5 ft.

If your township treats the spa as a pool, pool setbacks may apply too; Abington, for example, keeps pools 10 ft from side and rear lines.

Depth-based rules don't care what the tub is made of. If it holds more than 2 ft of water and your township uses a 2-ft trigger, ask the code office whether it counts.
